These Terms and Conditions set out the basis on which Waste Disposal Battersea provides waste collection, rubbish removal and related services to residential and commercial customers. By making a booking, using our services or allowing our team access to your premises, you agree to be bound by these Terms and Conditions.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual or business requesting or receiving waste collection or disposal services from Waste Disposal Battersea.
Company, we, us or our means Waste Disposal Battersea, the service provider.
Services means any waste collection, rubbish removal, bulky waste clearance, garden waste removal, commercial waste collection, recycling or related services provided by the Company.
Premises means the property, building or site from which waste is to be collected or where the Services are to be carried out.
Service Area means the general catchment area within which we operate and accept bookings for waste collection and disposal, including Battersea and surrounding locations.
We provide waste collection and disposal services for domestic and commercial customers within our Service Area. The type and volume of waste to be collected and the required collection date and time will be agreed at the time of booking.
Our Services may include, subject to agreement, general household rubbish removal, office waste collection, garden waste removal, bulky item collection, construction and renovation debris clearance, and regular scheduled commercial collections.
We reserve the right to refuse any item that is not suitable for collection, is prohibited by law, or which our staff reasonably consider unsafe or impractical to handle.
3.1 A booking may be made by telephone, email or online booking form where available. When placing a booking, you must provide accurate information including your name, contact details, collection address, description and volume of waste, access requirements and preferred dates.
3.2 We will provide an estimate or quote based on the information supplied. All quotes are given in good faith but are subject to revision if the information provided is inaccurate or incomplete, or if the actual waste volume, type or access conditions differ from those described at the time of booking.
3.3 A booking will be confirmed when we send written confirmation (which may be by email or text message) or verbally confirm the appointment and you indicate your acceptance of these Terms and Conditions. We may, at our discretion, require a deposit or prepayment to secure the booking.
3.4 It is your responsibility to ensure that a suitable person is available at the Premises at the agreed time to grant access, confirm the items to be collected and authorise any changes to the scope of work that may affect the final price.
4.1 You must ensure that we have safe, reasonable and unrestricted access to the Premises and to the waste to be collected at the agreed time. This includes arranging any necessary parking, loading bay access, entry codes, keys or permissions from building management or neighbours where relevant.
4.2 If we are unable to access the Premises or the waste due to reasons beyond our control, including locked gates, unnotified parking restrictions, or absence of an authorised person on site, we may treat this as a failed collection and reserve the right to charge a call-out fee or the full service amount.
4.3 You must ensure that the waste is reasonably packaged, bagged or contained where appropriate, and that any loose items are clearly identified for removal. We will not be responsible for mistakenly removing items that have not been clearly identified as to be kept.
5.1 All Services are provided in accordance with applicable UK waste management legislation and regulations. We hold or use appropriate licences, registrations and permits as required by law for the collection, transport and disposal of controlled waste.
5.2 We do not collect hazardous or specialist waste unless expressly agreed in advance and confirmed in writing. Prohibited items may include, without limitation, asbestos, certain chemicals and solvents, clinical or medical waste, pressurised containers, explosives, and other materials classified as hazardous or requiring specialist handling.
5.3 You are responsible for informing us in advance of any items that may be hazardous or require special handling, and for complying with any instructions we give regarding segregation, packaging or storage of such items prior to collection.
5.4 Ownership of waste transfers to us at the point of collection, provided that such waste is lawful for us to collect and dispose of. We will dispose of or recycle collected materials in accordance with applicable legislation, good industry practice and our own environmental policies.
6.1 Our charges are based on factors including, but not limited to, the type and volume of waste, labour required, access conditions, distance travelled within our Service Area, and any additional services requested such as dismantling, packing or waiting time.
6.2 Unless otherwise agreed, all prices quoted are exclusive of any applicable VAT or taxes, which will be added at the prevailing rate.
6.3 We may provide an estimate prior to arrival. The final price will be confirmed on site once our team has inspected the waste and access conditions. If the actual volume or type of waste is different from that originally described, we may revise the price accordingly. You will have the option to accept or decline the updated price before work proceeds.
6.4 Payment is due on completion of the Service unless we have agreed credit terms in writing. We accept payment by cash, major debit or credit card, or bank transfer where agreed. For commercial customers with credit accounts, payment terms will be as stated on the invoice.
6.5 If payment is not received by the due date, we reserve the right to charge interest on overdue amounts at the statutory rate and to recover any reasonable costs incurred in pursuing late or non-payment.
7.1 You may cancel or amend your booking by providing us with notice by telephone or email.
7.2 If you cancel with more than 24 hours notice before the scheduled collection time, no cancellation fee will normally apply, and any deposit paid may be refunded or applied to a future booking at our discretion.
7.3 If you cancel with less than 24 hours notice, or if we attend the Premises and are unable to complete the Service due to lack of access, non-availability of waste, or other reasons beyond our control, we reserve the right to charge a cancellation or call-out fee up to the full quoted amount.
7.4 We may need to reschedule or cancel a booking due to unforeseen circumstances, including but not limited to vehicle breakdown, staff illness, severe weather, or safety concerns. In such cases, we will use reasonable endeavours to notify you as soon as practicable and to offer an alternative appointment. We will not be liable for any loss or inconvenience arising from such rescheduling or cancellation.
8.1 You warrant that you are the owner of the waste to be removed or have full authority from the owner to arrange for its collection and disposal.
8.2 You must ensure that all information provided to us is accurate and complete, including details of the waste, access conditions and contact information.
8.3 You must not request the collection or disposal of any waste that is illegal to possess or dispose of, or that would require specialist licences which we do not hold.
8.4 You must take reasonable steps to ensure the safety of our staff while on your Premises, including the provision of a safe working environment free from unacceptable risk.
9.1 We will exercise reasonable skill and care in providing the Services. However, to the fullest extent permitted by law, our total liability to you for any claim arising from or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the total amount paid or payable by you for the specific Service giving rise to the claim.
9.2 We will not be liable for any indirect, consequential or economic loss, including loss of profits, loss of business, loss of data or loss of opportunity, arising out of or in connection with the Services.
9.3 We are not liable for any damage to property or items that arises from pre-existing structural defects, poor condition, faulty construction, or inherent weaknesses, or where you have failed to adequately protect items against reasonable risk of damage associated with waste collection activities.
9.4 You must notify us in writing of any damage or loss that you believe has been caused by us within 48 hours of completion of the Service, providing reasonable detail and evidence. We reserve the right to inspect the alleged damage before any liability is accepted.
9.5 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which it would be unlawful to exclude or restrict liability.
10.1 We will use reasonable efforts to attend at the agreed time, but any time stated for arrival or completion is an estimate only and not a guaranteed appointment time.
10.2 We will not be responsible for any delay or failure to perform our obligations where such delay or failure is due to events beyond our reasonable control, including but not limited to traffic congestion, road closures, accidents, severe weather, strikes, vehicle breakdowns, or other unforeseen operational issues.
11.1 We will collect and process personal information about you for the purposes of managing your booking, providing the Services, processing payments, and handling queries or complaints.
11.2 We will handle your personal data in accordance with applicable data protection laws and will take reasonable steps to keep your information secure. We will not sell your personal information to third parties.
12.1 If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible to allow us an opportunity to address your concerns.
12.2 We will investigate complaints in a fair and timely manner and may request additional information or evidence from you in order to resolve the issue.
13.1 We may amend these Terms and Conditions from time to time. Any updated version will apply to bookings made after the date of publication of the revised terms.
13.2 The Terms and Conditions in force at the time of your booking will apply to that booking, unless a change is required by law or regulatory authority.
14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
14.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.
15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable, and the remaining provisions shall continue in full force and effect.
15.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
15.3 You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations to another suitable provider, subject to maintaining your legal protections under these Terms and Conditions.
15.4 These Terms and Conditions, together with any written quotation or confirmation of booking issued by us, constitute the entire agreement between you and us in relation to the Services and supersede any prior understandings or agreements.
